RELEASE OF LIABILITY AND RIGHT OF ENTRY – READ BEFORE SIGNING In consideration of being permitted to participate in any way as a member or guest in the activities, social functions and tournaments of the Strathmere Fishing and Environmental Club, a fishing, social and environmental conservation club, as well as its related events and activities, I , the undersigned, hereby acknowledge, understand and agree to the following: 1. Participation in such activity, program or tournament is at the discretion of the SFEC and may involve significant risks and that I will, to the best of my ability, exercise personal responsibility and discipline to attempt to reduce any such risk, and; 2. I knowingly and freely assume all such risks, both known and unknown, as well as any consequences of such risks, including any risk or consequence thereof arising from any negligence on the part of myself or others, and I hereby assume full responsibility for my participation; 3. I willingly agree to comply with the stated and customary terms and conditions for such participation. I further agree that if I observe any unusual or significant hazard during my presence or participation in such activity, that I will refrain from any further participation in such activity and will bring such hazard or concern to the attention of the SFEC immediately; 4. I, for both myself and on behalf of my heirs, assigns, personal representatives and next of kin, hereby release, indemnify and hold harmless the Strathmere Fishing and Environmental Club (SFEC) and the Strathmere Fire Company and Board of Fire Commissioners as well as the officers, officials, agents, board members and/or employees of such organizations, other participants, sponsoring agencies, sponsors, advertisers and, if applicable, the owners and/or lessors of the premises used for such activity (“Releasees”) with respect to any all injury, disability, death, personal and/or property damage associated with my presence or participation in any of the aforementioned activities related or unrelated to the consumption of alcohol and whether arising from the negligence of the Releasees or otherwise, to the fullest extent permitted by law. 5. I further acknowledge and understand that my execution of this waiver shall automatically renew and become effective on an annual basis for each successive year that I remain a member of the Strathmere Fishing and Environmental Club (SPEC). I further acknowledge and understand that upon payment of my annual dues, this waiver shall automatically renew and become binding for each successive year that I maintain my membership and that I will not be required to execute a new waiver on an annual basis since the within waiver shall become operational, effective and binding upon myself for each and every year that I continue to remain a member of the SFEC. I HAVE READ THIS RELEASE OF LIABILITY AND RIGHT OF ENTRY AND I FULLY UNDERSTAND ITS TERMS AND FURTHER UNDERSTAND THAT I MAY HAVE FORFEITED CERTAIN LEGAL RIGHTS BY SIGNING IT AND I SIGN IT FREELY AND VOLUNTARILY.
